가나 대법원은 [1]가나에서 가장 높은 사법 기관이다.가나의 1992년 헌법은 입법부와 [2]행정부에서 사법부의 독립과 분리를 보장하고 있다.

역사

대법원은 식민지 [3]시대 골드코스트(현 가나)의 최고 재판소로서 대법원 조례(1876)에 의해 설립되었다.골드코스트 대법원의 항소는 1866년 설립된 서아프리카 항소법원(WACA)으로 넘어갔다.가나는 독립 후 WACA에서 탈퇴했으며 1960년 [4]런던 추밀원 사법위원회에 대한 항소를 철회했다.1966년 2월 24일 군사 쿠데타 이후, NLC(National Liberal Council)는 1966년 법원령(NLCD.84)에 따라 대법원과 사법권 기득권을 폐지하였다.즉, 상급법원과 하위법원이다.[5]1969년 제2공화국을 [6]수립한 헌법 102조 4항이 이를 뒤집었다.1972년 1월 13일 쿠데타 이후 1969년 헌법이 효력을 상실했다는 이유로 대법원은 다시 국가구원위원회에 의해 폐지되었고, 그래서 법원이 해석하고 집행할 필요가 없었다.그 기능은 [4]항소법원으로 이관되었다.이것은 1979년 [7]9월 24일 제3공화국이 수립되었을 때 1979년 헌법에 의해 다시 되돌아왔다.대법원은 1981년 12월 31일 임시국방위원회에 의한 쿠데타 이후 공공재판소를 [7]도입하여 법원 시스템을 변경했지만 그대로 유지되었다.

2013년 7월 2일 대법원은 데일리 서치라이트 신문 편집장인 켄 쿠란치에게 9명의 판사를 위선적이고 선별적이라고 비난한 혐의로 징역 10일을 선고했다.

1992년 헌법은 대법원이 가나 대법원장과 9명 이상의 다른 [8]대법관으로 구성되도록 규정하고 있다.대법원장은 국가평의회와 협의하여 [9]국가 의회의 승인을 받아 행동하는 가나의 대통령에 의해 임명된다.다른 대법관은 대통령이 사법위원회의 조언에 따라 국무회의와 협의하여 임명한다.이것 [10]또한 의회의 승인을 받아야 한다.1992년 헌법은 PNDC 산하에 설치된 모든 공공재판소를 폐지하고 고등법원 [7]판사와 동등한 의장이 있는 지방재판소를 만들었다.
