Franco Mulakkal은[1][2][3][4][5][6] 카톨릭 교회의 인도 원장이다. 2013년부터[7][8][9] 수녀를 성폭행한 혐의로 2018년 체포될 때까지 로마 가톨릭 잘란다르 교구의 주교로 일했다.[10] 그는 인도 가톨릭 역사상 강간 사건으로 기소된 최초의 주교다. 2022년 1월 케랄라 지방법원은 그에게 무죄를 선고했고 그는 모든 혐의에 대해 무죄를 선고받았다.[11]

성폭행 혐의 및 무죄 선고

2018년 6월 한 수녀가 비숍을 강간 혐의로 고발해 케랄라 경찰에 형사소송법 164조(인도 CrPC, Crpc)에 따른 고소장이 접수됐다.[15] 수녀는 2014~2016년 비숍이 세인트루이스를 방문하는 동안 13차례에 걸쳐 비숍에게 성폭행을 당했다고 주장했다. 프란시스 미션 홈, 쿠라빌랑가드.[16][17][18][19][20][21] 비숍은 2016년 한 여성이 수녀가 남편과 불법 관계를 맺고 있다고 주장하며 제기한 고소장에 대해 수녀를 상대로 조치를 취한 데 대한 보복으로 강간 이야기가 조작됐으며, 수녀는 조사를 벌인 끝에 마더 슈페리어 자리에서 해임됐다고 밝혔다.[22] 경찰은 처음에 수녀에게 준수를 신청했고 수녀는 하루 후에 준수를 신청했다고 말했다. 비숍은 고소장에서 수녀가 전학 등 징계를 받은 뒤 협박을 하고 있다며 가족들이 성폭행 사건에 휘말리겠다고 위협하고 있다고 밝혔다. 프란치스코 교황은 2018년 9월 20일 주교로서의 역할과 목회 의무에서 모두 휴직해 달라는 주교님의 요청을 받아들였다.[24] 2018년 9월 21일 케랄라 경찰은 비숍을 체포했다.[25][26][27][28] 케랄라 법무장관은 2018년 10월 20일까지 14일간 감옥에서 그의 사법적 구류를 연장했다. 케랄라 고등법원은 이 사건의 소명자료를 들어 주교의 첫 번째 보석 신청을 기각했다.[29] 그는 2018년 10월 15일 보석 허가를 받았다.[30] 2019년 4월, 케랄라 경찰에 정식으로 입건되었다.[31] 재판은 2019년 11월 시작됐다.

2022년 1월 14일, 추가 세션스 법원은 주교에게 모든 혐의에 대해 무죄를 선고했다.[11][32] 판사는 수녀의 증거에 '지나치게 꾸미고 꾸민 것'이 포함돼 있고, "알갱이와 꼬리가 뗄 수 없을 정도로 섞였을 때 증거를 토토로 폐기하는 것밖에 없다"[33]고 무죄의 근거로 밝혔다. 판결에 대한 반대가 확산되어 왔으며, 고소인과 그녀를 지지한 다른 5명의 수녀들을 지지하는 편지들이 소셜 미디어에 게재되었다.[33]
